Homeocan Inc. (“Homeocan” or “we”), Canada’s leading manufacturer and distributor of natural products, is committed to protecting the privacy, security and accuracy of the personal information it collects, in conformity with applicable legislation. Personal information includes, generally speaking, information about an individual which allows them to be identified.

This privacy policy (the “Privacy policy”) explains how we use and protect the personal information we collect from individuals who use our website and/or who are our customers (“you”), the whole to the extent necessary to offer and provide our products to our existing and potential customers.

CONSENT

BY PROVIDING PERSONAL INFORMATION TO HOMEOCAN OR ITS MANDATARIES, YOU CONSENT TO SUCH PERSONAL INFORMATION BEING COLLECTED, USED AND DISCLOSED IN ACCORDANCE WITH THIS PRIVACY POLICY AND AS REQUIRED OR AUTHORIZED BY APPLICABLE LEGISLATION. Subject to certain legal or contractual exceptions, you may at any time refuse or withdraw your consent by communicating with us in writing. However, it may be impossible for us to provide or continue to provide certain products or information if you refuse or withdraw your consent.

  1. The personal information we may collect

Homeocan may collect personal information from you, including: your name, your date of birth, your telephone number, your address, your email address, payment information (for invoicing purposes), information regarding delivery and your service preferences.

  1. How we use the personal information we collect

We may collect personal information from existing and potential customers for the following purposes:

(a) Providing products ordered: when you place an order, your name, telephone number, address and email address may be used in order to deliver the product(s) ordered and for follow-up regarding the transaction (sending an invoice, etc.).

(b) Processing payment: payment information (credit card number and other related information) is used only in order to process the payment when you place an order, and for no other purpose.

(c) Sending you information: we may sometimes send you information regarding our products and offers.

(d) Other purposes: we may sometimes use your personal information to identify unauthorized access attempts, errors, fraud, theft and other illegal activity and to protect from such activity Homeocan, you, our customers or third parties, to evaluate the implementation of our policies and conformity with Homeocan’s legal and contractual obligations, to communicate with you and conduct surveys, research or evaluations, and for any other purposes we may indicate from time to time.

  1. How we disclose your personal information

We may disclose your personal information to third parties, including in the following cases:

(a) Service providers: we may disclose your personal information to third parties who provide services to us or in our name, including contract agents, providers of shipping, delivery, data processing, file management, and office services, collection agents or our auditors. We will provide only the information necessary for the provision of the service by the relevant third party, and any use by them for other purposes shall be prohibited.

(b) Members of our group: we may disclose your personal information to corporations belonging to the Homeocan group (i.e. Homeocan Inc. and its affiliated corporations) in order to better serve you and provide you with information about the products and services offered by our group

(c) Transfer of activities: if all or part of Homeocan’s activities are sold or transferred, Homeocan may transfer to the purchaser or transferee the personal information of its clients, provided that the transferee shall agree to protect the privacy of the personal information in conformity with the principles set out in this Privacy policy.

(d) Disclosure under law: Homeocan may disclose your personal information if authorized or required by law, a subpoena, warrant or order of a court or competent body or authority. Homeocan may disclose your personal information to its legal advisors.

You may at any time indicate to us that you refuse that we continue to use your personal information in the manner set out in sections 3(a) to 3(c) by communicating with us (see section “How to contact us”).

  1. Control of your personal information

You always maintain control over our use of your personal information. Notably, you may at any time:

  • Indicate your refusal that we use or disclose your personal information for some of the purposes set out in sections 2 and 3;
  • Request that we use no nominative information and only provide the product(s) ordered; 
  • Unsubscribe from our email communications, using the option to that effect provided in every email communication.

However, please note that it may be impossible to provide or continue to provide you with certain products or information if you withdraw consent to the use of your personal information.

We store your personal information in secured locations and servers controlled by Homeocan, located at the places of business of our service providers. 

  1. How to access your personal information

You may at any time communicate with us to access the personal information we have collected about you. To do so, please address your request in writing to our privacy officer (see section “How to contact us”).

Homeocan will allow you to access the information we have collected about you and will inform you of its use and disclosure. You may request that we correct or update your personal information as required. Verifications regarding your identity may be required before access.

  1. How we protect your personal information

We allow access to the personal information of our customers only to our employees and to third parties identified in section 3. Only the information relevant and necessary for the purpose of the disclosure is disclosed to third parties. All persons having access to personal information are obligated to protect its privacy, either in the context of their employment, or of the contracts we enter into with third parties.

We retain only the information useful for the purpose of providing you with the products and information you request. Upon your request, we will erase all personal information we have collected about you and will retain no copy (see section “How to contact us”).

We have put in place reasonable protective measures, physical, organizational and technological, in order to protect the information collected by Homeocan against loss or theft, as well as unauthorized access, modification or use. These mechanisms and this Privacy policy are reviewed regularly and amended as necessary.

Credit card information is protected by security and encryption processes in conformity with industry standards.

However, Homeocan cannot guarantee that unauthorized access and violations of security measures will never occur. You therefore recognize that you provide personal information through the website at your own risk.

  1. Protection of privacy and our website

This section contains information regarding the personal information collected through Homeocan’s website.

Cookies – When you use our website, we may use “cookies”, which allow us to obtain certain information about your visit, e.g.: the date and time of your visit, the pages you visited, the duration of your visit, the searches you made, the domain name used to access our website, or the type of Web browser used. A cookie identifies the browser accessing the website, but not the visitor himself. Unless you inform us of your identity (e.g. by creating an account on our website), we cannot determine your identity using cookies. We may use this non-personal information in order to evaluate the use of our website and to optimize it to our customers’ needs.

Email communications – As mentioned in section 2, we may sometimes communicate with you by email regarding products ordered or for promotional purposes (e.g. regarding products of Homeocan or commercial partners which may be of interest to you, or special offers). Every email communication will include the option to unsubscribe from such communications, or to indicate your preferences regarding the type of communications you wish to receive, as applicable. If you send us an email, we may keep a copy of the email, the email address used to send it, and any subsequent communication between you and us.

Searches – When our customers use the search functions of our website, we may keep a history of search terms in order to evaluate the needs of our customers and to optimize our website and product offering.

Hyperlinks – Our website may contain links to other websites. When you use those links, you access websites managed by third parties. Homeocan is not responsible for the practices in effect on these websites regarding the collection, use and disclosure of personal information. We invite you to consult the privacy policies in effect on these websites before providing personal information.

Minors – Individuals under 18 years of age should obtain the permission of a parent of guardian before providing personal information on our website. Without authorization, they should never provide personal information about themselves, no matter the reason.

  1. Modifications to this Privacy policy

Homeocan reserves the right to modify this Privacy policy at any time. Should we effect any modifications, those modifications will be displayed on our website and we will take reasonable measures to inform the persons concerned, as necessary. You may also communicate with Homeocan’s privacy officer at any time to obtain an up-to-date copy of the Privacy policy (see section “How to contact us”). We invite you to review this Privacy policy occasionally to stay informed of eventual modifications.

Homeocan will always obtain your consent before collecting, using or disclosing your personal information for purposes other than those for which you have given your consent in accordance with this Privacy policy, except as authorized or required by law.
